Each addendum adds to the Wise Terms of Service for customers established in that region. Delaware law still governs everywhere; the addenda only add what local law makes mandatory.
Each addendum applies when the Customer is established in, or has its main place of business in, that region. It forms part of the Agreement and prevails over the Terms where they conflict (Terms Section 1.3). The base contracting entity (Wise Leap Technologies, Inc.) and Delaware governing law do not change. Capitalized terms have the meanings given in the Terms. Each addendum is published as its own page at wise.live/legal/uk, wise.live/legal/eu, wise.live/legal/au and wise.live/legal/us.
UK.1 Scope. This UK Addendum applies if you are established in the United Kingdom.
UK.2 Data protection. For Customer Data subject to the UK GDPR and the Data Protection Act 2018, the DPA applies together with the UK International Data Transfer Addendum, as completed in the DPA.
UK.3 Children. If you use the Service with children in the UK, you will configure it consistently with the ICO's Age Appropriate Design Code. That means high-privacy settings for child profiles by default, and recording and AI Features used only where you have assessed them as appropriate. Wise will provide reasonable information to support your assessments.
UK.4 Split payments. Terms Section 6.5 does not apply to split payments. For split payments, refunds, chargebacks and disputes are handled as required by the Payment Services Regulations 2017 and the Payment Processor's terms, and you will cooperate with Wise and the Payment Processor to resolve them.
UK.5 Liability. Nothing in the Agreement limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under the law of England and Wales.
UK.6 Individual customers. If you use the Service as an individual outside your trade, business or profession, your statutory rights under the Consumer Rights Act 2015 are not affected.
UK.7 Online safety. You are responsible for moderating Messaging under your account, as set out in Feature Terms F1. Wise keeps a reporting route at info@wiseapp.live, and may remove content or restrict accounts where the Online Safety Act 2023 requires it.
UK.8 Marketing messages. If you use the Service to send emails, SMS or other electronic messages, you are responsible for complying with the Privacy and Electronic Communications Regulations 2003.
UK.9 VAT. Fees exclude VAT. For business customers, VAT is accounted for under the reverse-charge mechanism where it applies.
